    Thank you for taking the time to clear things up for those who may still feel like they are in the dark on this issue. I appreciate it.

    I know who Tim Waltz is, but we’re discussing an individual in California, not Minnesota, who is not a violent offender and who has not been found guilty of a crime in court. We’re discussing someone who has been an ASSET to our club in multiple ways and considered as such by multiple pilot members in good standing with the club. He’s not perfect (who is??), but he is considered one of us.

    We are discussing the board taking actions AGAINST our by law rules. Certain board members are the ones not following the rules, abusing their position and citing legal reasons that don’t exist, as reason for calling the police. I’ve known these people for years, I’ve worked with them before, I am not enjoying having to call them out on their wrong-doing. I am blowing up friendships over this, because wrong is wrong and right is right. I am acting on behalf of multiple members who don’t want to participate here, but feel very much the same as I do.

    You are entitled to your opinion on wrong vs. right, but it would help a great deal if you did have personal experiences with those of us relevant to this discussion. Unfortunately you have to rely on the information here rather than on your own personal experience. Corporate word salad sounds and looks good, but it doesn’t mean it’s rooted in reality. The outcome of this doesn’t affect you the same way as it affects those of us locals who are frequenting AJX multiple times a week for years on end. Now excuse me while I step away for the day and go do some flying with these people.

    On the topic of governance, I wanted to mention that, given the apparent lack of written unanimous consent, the California Nonprofit Public Benefit Corporation Act (the Act) required the board’s action to cancel Steve’s membership to be taken within a properly noticed and constituted board meeting where minutes would have been taken. Additionally, under the Act and our bylaws, the membership had a right to attend such a board meeting.

    I also still contend the board’s action to terminate without a hearing violates both the Act and our bylaws. Additionally, as long as he is not squatting on the CSS property or the our neighbors property, Steve poses no long term danger or determent to the club and that the board’s actions here have been too heavy handed.

    You are either a liar, or you are getting bad information, or you are manipulating what you have ‘heard’ for your own benefit. Which is it?

    I know who owns the cameras.  I do not have, nor have I ever had, access to any of them nor have I ‘tampered’ with any of them. So, no, my access to them hasn’t been revoked by the owners because I never asked for access to them.  Do you want to correct your claims?

    FYI… since the answers to your questions that Mimi has provided just aren’t good enough for some people.

    1. Jana keeps blaming me personally for revoking Steve’s membership.  This was a board vote, based on Steve’s actions and that his membership was purchased for him in bad faith.

    2. The BOD is not ignoring the by-laws.  Steve is not a member, so he is not entitled to the disciplinary process afforded to members in the by-laws.  Purchasing a membership does not absolve an individual from a long history of abusing club resources and automatically afford them the rights of a member in good standing.

    3. The view that Steve is an asset to the club is completely subjective.  We have already documented in our responses the various issues he has caused and the risk that he brings with his behavior.  One member cannot make a decision on behalf of all members that the club’s resources will continue to be made available to Steve to support is lifestyle.  We are a free-flight club, and Steve’s actions over the last 8 years are not consistent with that purpose.

    This is incorrect. As statutory members (under the California Nonprofit Public Benefit Corporation Act), all members have specific rights. The termination of a membership must be consistent with the requirements of the Act and the bylaws. The board’s action did not comply with those requirements. While I do not anticipate Steve seeking relief from a civil court, that does not mean the actions of the board were legal.

    The board wishes there was a provision of the bylaws that allowed them to review membership applications, but, until the bylaws contain such a provision, the board does not have such an authority. The society accepted the consideration for his membership and published his name as a member. He was a member.

    This would have been so much simpler if the board had just followed the requirements of the Act and the bylaws for a hearing.

    Thomas, you have no idea how the website works do you?  A membership is processed automatically and the name appears on the website.  ‘The Society” did not accept, Jana unilaterally placed the responsibility on the backs of all club members to continue allowing Steve access to the club’s resources.  Keep reaching.

    But thanks for pointing out the flaw in the website… we will get that fixed.

    Luke, I completely understand that the membership is automatically accepted on the website. But, absent a legal, bylaw authority to further review memberships, or even a routine practice of reviewing memberships, that automatic acceptance is an acceptance of the membership. Has the board ever reviewed a membership application before?

    Additionally, this does not address the substantive point that the bylaws do not empower the board to review applications or terminate them without a hearing. The board could still have this hearing. Is there an application process that the membership is not aware of? What authority is the board relying on to terminate his membership? Did the board take this action during a properly noticed board meeting? Were members allowed to attend this board meeting?

    Finally, this is the second time you have been unreasonably abrasive in responding to my comments requesting the board to be more in line with both the bylaws and California law. I have tried to remain cordial in my comments on this issues and the minutes.  If you are this way with club members, it really makes me concerned if you have the right temperament to negoate with Encore on behalf of the club.

    Thomas… I can smell passive aggressive from half a click upwind.  We’ve responded reasonably to your attacks and since you can’t seem to understand basic facts, I will respond in kind.

    For the 50th time, Steve’s membership was purchased in bad faith.  Steve was a squatter on a neighbor’s property that threatened litigation against us if we continued to enable his behavior.  Steve immediately moved back onto club property after he was evicted from Encore property.  The rest of the membership, who pay the dues which provide the operating budget for this club, have zero obligation to allow Steve to subsist off club resources indefinitely.

    I know for a FACT you as President was given the link to the cameras along with a few other BOD members that now do not have access due to YOUR actions.
    When we ran electricity to the OLD shade structure, cameras were installed for security, and weather. There was a camera pointed at the storage containers. They went away when the old structure blew away.
    The cameras that are there now were put up by a member at his cost for the same reasons since the club did not install any after the new shade structure was built. The main concern was the storage bins since they’re housing thousands of dollars of gear. There was 3 total. 1 pointed to the north of the shade structure looking at the training hill and Marshall (which someone redirected recentley). The 2nd looked out towards the LZ which had recenently failed and not replaced. The 3rd is pointed at the storage containers.
    These were never intended to spy on members.
    You recently called a member to accuse him of stealing water to give to Steve after you watched him on the camera walking with a pot of water. That to me looked like he was cleaning up the pot from whatever was cooked in it and dumping it out in the bushes. You weren’t even there so how would you know without looking at the camera recorded events video or watching real time? Who would ACCUSE A MEMBER OF STEALING WATER???? YOU!
    So then there’s Steve at the LZ and as Mimi said it was “Documented” but she never said how it was documented. She’s never had access to the cameras so who documented it and how? You Luke? I guess we will never know?
    For you to say you never had access is BS and calling Yana a LIAR is BS!
    Like I said before it’s  a personal vendetta for not only you but now Mimi as well!

    While Thomas is passive aggressive, you are just plain aggressive.  By Thomas’ standards, you probably shouldn’t be a part of this conversation.

    So if you know for a FACT (I only put it in caps because you did), that I was given the link to the cameras, then prove it.  I mean, I don’t have access to the cameras and I really don’t know how to prove that.  I just don’t have it, and never did.

    The interesting part is, YOU don’t seem to know who owns the cameras, or at least, you don’t know that there is more than one set installed by different owners.  In any case, I don’t have access to any of them.

    Yes, pictures were provided to me by text from those cameras.  I did talk to Reed about why they were hauling water down the stairs at the LZ.  I didn’t accuse him of anything, I asked him what he was doing and he told me.  Everything in your rant is gossip and completely unproductive.

    Nah Buddy, you started the accusations.  You have to prove that I have access to the cameras, not the other way around.  Since you know it for a FACT, the burden of proof is on you.

    Since you need a little help; some of the cameras belong to Dusty, the others belong to Owen.  Now prove that I have access to them.  I’m waiting.

    As a bonus, maybe you can prove that I tampered with them? I know Jana said that, not you, but I mean since you have all the FACTS, why not go the full monty?

    You can’t answer the question, so ok, I guess it’s not a fact then?

    All the cameras are in plain sight.  Again, you don’t know what you claim to know.

    The pictures were sent to me.  I never claimed the camera owners sent them.  I have no idea how many people saw them before I did, but what does any of this even prove? Nothing. More gossip and unproductive drama.
